  • You have the legal capacity to enter into this agreement

DemTracker is a cognitive health screening tool designed to help families monitor cognitive patterns over time through quick, research-backed assessments.

The Service provides:

  • 10-minute cognitive screening tests based on validated methodologies
  • Probability scores and signal bands (low/medium/high)
  • Historical tracking and trend visualization
  • Optional AI-powered summaries comparing recent test results
  • Multi-family member profile management
  • Data export capabilities

3. User Accounts

To use DemTracker, you must create an account. You agree to:

  • Provide accurate information: All account and family member information must be truthful and current
  • Maintain security: Keep your password secure and do not share login credentials
  • One account per user: Do not create multiple accounts for yourself
  • Notify us of unauthorized access: Contact us immediately if you suspect account compromise
  • Manage family members responsibly: Track up to 20 family members with appropriate consent

You are responsible for all activity that occurs under your account. DemTracker is not liable for any loss or damage arising from unauthorized use of your account.

  • Do not use DemTracker results to make treatment decisions without professional guidance
  • Always consult a doctor, neurologist, or geriatric specialist for medical evaluation

By using DemTracker, you acknowledge and agree that:

  • The Service provides informational screening results for personal monitoring purposes only
  • High signal bands or concerning trends warrant professional medical consultation, not self-diagnosis
  • DemTracker's 94% accuracy refers to screening signal identification, not clinical diagnosis
  • Cognitive health is complex and requires comprehensive professional evaluation
  • You will not rely solely on DemTracker results for medical decisions
  • You understand that screening tools have limitations and may produce false positives or false negatives

In case of emergency or acute cognitive changes, contact emergency services or a healthcare provider immediately—do not wait to use DemTracker.

5. User Responsibilities

As a user of DemTracker, you agree to:

  • Use the Service appropriately: Administer tests in a quiet, distraction-free environment
  • Obtain proper consent: Ensure family members understand and consent to being tested
  • Provide accurate responses: Answer test questions honestly without coaching the test-taker
  • Respect privacy: Do not share sensitive test results without the family member's permission
  • Report issues: Notify us of bugs, security vulnerabilities, or technical problems
  • Follow professional guidance: Share results with healthcare providers when appropriate
  • Use judgment: Recognize when professional help is needed beyond screening

6. Prohibited Uses

You may NOT use DemTracker to:

  • Commercial purposes: Resell, sublicense, or profit from the Service without written permission
  • Automated access: Use bots, scrapers, or automated tools to access the Service
  • Reverse engineering: Decompile, disassemble, or attempt to extract source code
  • Medical practice: Use DemTracker as part of professional medical services without authorization
  • Fraud or misuse: Manipulate test results, create fake profiles, or abuse the system
  • Harmful activity: Upload malware, spam, or engage in any illegal activity
  • Circumvent restrictions: Bypass security measures or access controls
  • Overload systems: Generate excessive load that disrupts service availability

Violation of these prohibitions may result in immediate account termination and legal action.

7. Intellectual Property

All intellectual property rights in DemTracker, including but not limited to software, design, text, graphics, logos, and screening methodologies, are owned by DemTracker or its licensors.

Our Rights

  • The DemTracker name, logo, and branding are protected trademarks
  • Question sets and screening algorithms are proprietary
  • All code, databases, and infrastructure belong to DemTracker

Your Rights

  • You retain ownership of your account data and test responses
  • You may export and use your data for personal purposes
  • You grant us a limited license to process your data to provide the Service

Limited License

We grant you a non-exclusive, non-transferable, revocable license to use DemTracker for personal, non-commercial purposes in accordance with these Terms.

8. Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY AS IT LIMITS OUR LIABILITY TO YOU.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or completely secure
  • Warranties regarding the accuracy, reliability, or completeness of screening results

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEMTRACKER SHALL NOT BE LIABLE FOR:

  • Medical decisions: Any harm resulting from reliance on screening results
  • Indirect damages: Lost profits, data loss, or business interruption
  • Third-party services: Actions or failures of third-party integrations
  • User error: Mistakes in test administration or data interpretation
  • Force majeure: Events beyond our reasonable control

In jurisdictions that do not allow exclusion of certain warranties or limitations of liability, our liability shall be limited to the maximum extent permitted by law.

IF WE ARE FOUND LIABLE, OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID TO USE THE SERVICE IN THE PAST 12 MONTHS (WHICH IS $0, AS THE SERVICE IS FREE).

9. Indemnification

You agree to indemnify, defend, and hold harmless DemTracker, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including privacy or intellectual property rights
  • Medical decisions made based on screening results
  • Testing family members without proper consent
  • Any fraudulent or illegal activity conducted through your account

10. Termination

Termination by You

You may terminate your account at any time from your account settings. Upon termination:

  • All your data will be permanently deleted within 30 days
  • You will lose access to all test history and family member profiles
  • This action is irreversible—deleted data cannot be recovered

Termination by Us

We may suspend or terminate your account immediately if you:

  • Violate these Terms or our Privacy Policy
  • Engage in prohibited uses or fraudulent activity
  • Cause harm to other users or the Service
  • Fail to respond to requests regarding suspicious activity

Effects of Termination

Upon termination by either party:

  • Your license to use DemTracker terminates immediately
  • Sections 7-11 of these Terms survive termination
  • Outstanding obligations remain enforceable

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where DemTracker operates, without regard to its conflict of law provisions.

Dispute Resolution

In the event of any dispute arising from these Terms or your use of the Service:

  • First, contact us at support@demtracker.app to attempt informal resolution
  • If informal resolution fails, disputes shall be resolved through binding arbitration
  • You waive the right to participate in class action lawsuits
  • Arbitration shall be conducted by a mutually agreed arbitrator
  • Each party bears its own legal costs unless otherwise awarded by the arbitrator

Some jurisdictions do not allow certain limitations, so these restrictions may not apply to you.

12. Changes to Terms

We may modify these Terms from time to time as the Service evolves or legal requirements change.

Notification of Changes

When we make material changes:

  • We will update the "Last updated" date at the top of this page
  • We will notify you via email (if you've opted in)
  • We will display a prominent notice in the application
  • For significant changes, we may require explicit acceptance

Your Options

After notification of changes:

  • Continued use of the Service constitutes acceptance of the new Terms
  • If you disagree with changes, you may terminate your account before they take effect
  • Termination is your exclusive remedy for disagreement with Terms changes
